Has the Second Amendment Failed?

There has been a lot of debate lately about gun control. After the Connecticut school shooting I wrote my opinions, which can be found here: (Click Here)

I am a proud owner a 1911 Colt .45 and enjoy my right to bear arms; and unlike most Americans I understand the amendment that gives me that right. I didn’t weigh in on the gun control issue at that time, but now I believe it is time to do so. The problem with debating gun control is that most people on both sides simply don’t seem to understand the second amendment. That’s where we will start and end our conversation today. Since it is a complicated and emotional issue, there are several points I want to make here.

Obviously this guy is, Irwin Podhajser, is a “useful idiot”. The Second Amendment is not dead and never will be. Every American must demand from their state and federal legislators that no gun control can exist because the 1968 US Gun Control Act was adopted verbatim from the 1938 Nazi Weapons Act because of Democrat Senator Thomas Dodd (D-CT), father of former Sen. Chris Dodd (D-CT).

The Democrat Senate in 1968 passed the US Gun Control Act using Nazi laws. Anyone proposing further gun control or trying to enforce gun control is committing felony Official Misconduct for violating their Constitutional Oaths of Office to uphold, support & defend the US Constitution. In addition, they are also committing Treason and Sedition.

  Yeah, apparently, Irwin doesn’t understand his rights at all. He is not granted the right to bear arms by the Second Amendment. Our Founders were clear that the right of defense was a natural, or God given, right and that it is only affirmed by the Constitution. If the Second Amendment was stripped from the Constitution, It could not remove a right that comes from God. The Bill of Rights was written to restrain government, not bestow rights already possessed. Seems to me, the far left is itching to pick a fight. I would suggest that gun owners are the absolutely wrong target.

  Eh, that’s not what I got out of what he said. Yes, if you take his headings and pleadings at face value, I understand your take. What he implies is quite different. He’s juxtaposing the issue, approaching from the standpoint that we, the people, have been napping and we have let this “idiocy” creep upon us by just giving in a little. We have been silent so many years–somewhat thinking madness will eventually become obvious and then common sense will prevail–but complacency only allows erosion and we are at the point where either the dam will break if we don’t vigilantly repair the breaches and buttress even further.I don’t believe Irwin is waving the white flag as much as he is calmly saying we can continue down the road to stupid or we can NOW kick the engines out of reverse and get this country back on the road to Constitutionality.   “Our founders thought there would be many revolutions in our history.” That gives his true message away. Yes, we suffered through the Civil War for a less-than-noble concept of freedom of not all men, just the ones we think should be free. Then the same rebels (and I am a born Southerner myself) made it a point over the next century to “rebrand” themselves as the “liberators” while the Republicans stood by thinking the world would see through this weak deception. Even the heralded MLK was co-opted posthumously by the Democrat party aided by race hustlers who told their followers it was rich Republicans who were the enemy. Without Republicans, the Civil Rights Act would never have passed if it was left up to the likes of Democrats like Robert Byrd, Gore Sr., “Bull” Connor, George Wallace, et.al. But buying votes with the “Great Society” programs allowed these confirmed racists–all Democrats–to skate by and acquire the votes needed to stay in power. And Republicans didn’t bother highlighting the truth much like today.

Well, you have to have be 65 to have seen it develop Yuri Bezmenov, a KGB defector tells us how and why it happened in this 1984 TV interview. He is wildly prophetic and accurate. He talks about the Communist KGB design to take down America from within. This he says was well along by then (1984). He talks about the demoralization of America. By that he means denigrating religion, promoting sexual promiscuity, abortion, patriotism. He says how the effort was made to go after people in power; educators, Hollywood, journalists.TV.   Actually it started happening before then- Dewey (of the ‘Dewey decimal system) got the ball really rolling when he was the head of the Education department for this country. The policies he implemented started us down this slippery slope. He was an avowed communist and we can see were he guided us through the education system.

Cuomo and NY just passed THE MOST STRINGENT gun control laws to date. Maryland is probably next, and even though Obama can’t pass sweeping federal gun-control, he will ‘conceded’ that it’s a states rights issue and let it be whittled down to nothing BEFORE 2A is relegated to the dustbin of history.

I think what has failed is that we have not used our powers to limit our federal government. It has gotten way out of hand. We have also failed to maintain a moral society. Our moral values have been pretty much thrown out the window.

I’d submit that it’s not the 2nd Amendment that failed but the American people. After decades of brainwashing by the “progressive” education system they no longer comprehend the ideas of freedom and personal responsibility. Those who want to be “cared for” by “the government” (at the expense of their fellow citizens) rather than left alone to care for themselves cannot be trusted to care for freedom.

It is time to reset this country and wipe the slate clean. If we as a people are not willing to do that – and do it in whatever manner it requires, including the noose or firing squad to remove the enemies of our Constitution, then we need to shut up, roll over and take what comes with being enslaved by a heinous monster called the federal government.

After 4 years under this anti-American regime, it would have been difficult for even the most aggressive person (I’m referring to a newly elected President) to clean out the minions that have been infiltrated into even the lowest positions in the government. Now it is damned near impossible without a complete and utter house cleaning – a fumigation if you will – all the way down to the janitors! Administration cronies are in the Pentagon, and the entire military is being infested with vermin. Top generals not loyal have been sacked/purged, call it what you like.

It’s time to take the crown from the king and take the executive branch back to being co-equal.

Let’s stop talking, roll up our sleeves and get to work…what say you?

Woodrow Wilson (D) Pres. US in 1912 authored the 17th Amendment that removed the US Senators from the control of the states from which they came from. This folks placed the Senators in the same box with the Legislatures of which has developed an oversized central government. Exactly 100 years later Wilson got what he wanted and that is the mess we are in today. Repeal Amendment 17 and the people will get their freedom back and the government could be downsized.

There is no “AMENDMENT” that “gives” you the right – That RIGHT is INHERENT in your very existence. Nice gun, by the way, I have a pair of 1911, .45acp, myself. The sole purpose of the Second Amendment is to stand as an absolute guarantee that our “Representative Government” never interfere, or “infringe”, on that inherent Right.

The Colonials of the time often armed themselves with weapons far superior to the standard issue .75 cal, smoothbore flintlock “musket” (a “musket” is a military longarm) – namely, the flintlock rifle.

The Second Amendment clearly states – “without infringement” – thus, no restrictions. Do a little research, you will find that “arms” of the day was any military style weapon that could be fielded by a crew of three men or fewer – think about that in modern terms!
The purpose was that the Free Civilians be capable of meeting a military force, government controlled, with some hope of success – you can’t do that with the “Feinstein Single Shot”.
When the “bad guys” come, government, gang, thief, rapist, or murderer, you must have superior weapons, superior skills, or superior numbers, in order to prevail …. preferable, all three. But, since that is rather unlikely, one must do what one is able.
I guess you could always follow Lot’s example, when they come for your sons, offer your daughters. But, bad guys being bad guys, they would probably take both, along with the wife & yourself, as well.

You can not say that the second amendment is there to allow individuals or groups take action against the government. Whatever the amendment says about the right to keep and bear arms it says in the context of a well regulated militia. The constitutions give further definition of such militias they exist to put down insurrection and to defend against invasion. they are to be governed (regulated) according to rules established by congress (i.e. they are under the authority of the Federal Government)

The author misunderstands the nature of the Bill Of Rights. That portion of our Constitution grants us no rights whatsoever. All rights that we have are inherent in all men and are merely guaranteed by the BOR, save those we voluntarily delegate to the government, which delegation can be rescinded by We The People (and likely should be at this time, to allow the Constitution to be reinstated as the highest law of the land).

Actually, the second amendment did not fail. It should have been implemented already. When written, our founders envisioned a violent overthrow to get us where we are today. In that case, good people, would have risen up. These tyrants are bringing about the means to their end, by subversion, infiltration and regulation, without fireing a shot. Now this gun crisis, once again, is a means to an end. This tyrant knows that eventually, patriots are going to catch on. When that happens, guns must be gone. They can not complete their plan if Americans are armed. So, they will milk this cow as long as possible, and hope the groundswell of support will go their way and patriots will not catch on untill it is too late..

You are caving. Freedom comes at a high price. You have to be willing to pay it or you loose it. They can pass all the gun laws they want and it will do no good. You see, criminals and the mentalily ill do not go by laws. Government knows that, if they don’t then they are stupid. The present administration has an agenda and they use these terrible events to fullfill it. If people can’t see whats happening, then they are stupid. The first en amendments – the Bill of Rights – were approved in convention in 1787 as part of the Constitution and ratified by the majority of States in 1789. They are part of the original Constitution and enumerate the most sacred morals and values of America. The second amendment is not a failure. The government pukes are trying to start a fight as they are about to dump something on us that is much more hideous than gun control. Gun control is just a way to divert our attention…Try immigration reform, extremely high taxes, muslim religion being taught to our children…more liberal supreme court justices so Christians and Jews alike will have targets on their back. This is one large ploy, however, that blow up in their faces. They thought we were going to lie down and take whatever they wanted to cram down our throats…Then along comes the Tea Party and a whole bunch of other patriots that are pushing back. And, most patriots will agree, if a civil war is to be, then let it rip! And, if I could own a tank, I would love too! Or even a bazooka! I would submit that it has not failed, YET! They can pass whatever they WANT in terms of firearms control in DC. The rubber will hit the road when it’s time to ENFORCE their illegal decree. We outnumber EVERY federal employee both armed and NON-armed, by over 70 to 1. Pure math and logic predetermine the outcome of a collision between the federal government and an armed, VERY pi$$ed off American citizenry.
This very topic of conversation is being had across MILLIONS of family dinner tables, on many a local barstool, chuch gatherings, at the work watercooler, amongst family, EVERYWHERE. We collectively understand that the 2nd IS a line in the sand that MUST BE DRAWN. Americans are now coming to grips with the fact that a showdown for their children’s future AND OURS, is quickly coming to a head.
I harbor LITTLE worry about those on the fence that claim they will NOT jump into the fray. Why? Because NO American gun owner I KNOW will sit back and tolerate their neighbor’s doors getting kicked in, families being shot for non-compliance, folks being dragged out in their nightclothes by their hair and thrown into transports to destinations unknown, empty government trucks backing into neighbor’s driveways and confiscating everything from generators to food, stored water, medications, survival stores, whatever. What would YOU do if this began unfolding before your eyes? Or if you heard it manifesting a block or 2 away, and you heard the screams and the gunshots? Would you wait passively for it to reach YOUR street, with hand towels and a pitcher of lemonade for the federal usurpers, OR WOULD YOU BLOW THE BRAINS OUT OF ANY FEDERAL ENTITY YOU COULD SEE THAT CROSSED YOUR SCOPE OR OPEN SIGHTS? Remember, they’re coming for YOUR family NEXT! Would you sit with your thumb in your mouth and go fetal, as the progressive THINKS you will, or do you start firing with EVERYTHING you’ve got to defend hearth and home? EXCELLENT blog! A couple of points I would add. Some argue, “The Right To Bear Arms Only Works In A Moral Society”.
Actually it’s just the opposite. It exists because of an immoral society. A moral society does not need any guns. That society does not exist. The 2nd Amendment is a check and a balance against an IMMORAL society which would empower an IMMORAL government. It empowers the innocent to put evil in check, and gives the common man the ability to defend himself against the wicked, who would with enough ‘votes’ enslave him.
I disagree that a change to the constitution would eliminate my right to bear arms. ‘Prohibition’ was passed by hook and by crook, and so was the 16th Amendment that supposedly gives this government the power to enslave me with taxes. These rights exist from God, and CANNOT be taken away lawfully, by ANY change to a manmade document.

You can argue all you want that the Second Amendment does not limit arms’ ownership, but this does not change the fact that because the Constitution only recognized it as a right, arms’ ownership has been controlled, licensed, and limited by the government that placed it under its jurisdiction.

Rights are but another means by which we have sold down the river:

All of this yap yap about our Second Amendment. The amendment has not failed for sure proving it’s value to stop tyranny. All that are against the second are really striving for total governmental control, Tyranny. Absolute power corrupts absolutely. Stand behind our freedoms stand tall protecting the second amendment. Don’t even need to own a gun to understand the value of the second amendment, just a working brain that can comprehend tyranny.

Again I say the second ammendment has not failed, nor has the rest of our Constitution. The “two party” system has failed not the biblical premises and the constitutional boundaries that built our republic. One dominant party (the democrats) have sold out to a totalitarian socialist agenda, ruled by an elite few. (tyranny) The other party ( the republicans) has sold out to multinational corporations, who’s primary interest is profits and not the well-being of americans. These parties are supported by special interests seeking to neutralize the family, indoctrinate our children, generally gain power and influence and eliminate those institutions (churches for example) that embrace sound principles. Those americans that choose to ignore this process (“politics is dirty and corrupt so I won’t do anything”) are aiding and abetting the culprits. Liberty has a price. The “down payment” is vigilance and the “monthly (periodic) payment” is diligence.

I agree with JohnM: The second amendment did not fail; what failed was the people not paying attention to the socialist taking over the education of our children. Our children never learned what a Constitutionally limited Republic is, what sovereignty is, what God-given rights are, how the Constitution recognizes those rights, and what the cost of freedom is. All they were taught was self-esteem, big government is good and protects us cradle to grave, and how to put condoms on a cucumber.

WE the PEOPLE have failed to hold politicians accountable to the Constitution. Only by standing up and defending the Constitution can we survive.

The II has not failed us, we have failed it.

Liberals are right about the II: it is not about arms, per se, it’s about the militia. Anyone who claims to support the II, but who does not belong to a militia is a hypocrite or ignorant.

Yes, the II does assure us the right to keep and bear. But this is a redundancy since there is nothing in the Constitution that gives Congress the power to take our guns or limit our possession of them in any way. If the Document does not give ‘em that power, they don’t have it. The phrases, “… the right of the people to keep and bear arms …” and “… shall not be infringed” make it clear that keeping and bearing are inherent rights (no less than “life, liberty and the pursuit of happiness” from Jefferson’s glorious declaration). Government did not give ‘em to us, and government has no legitimate right to take ‘em away, unless and until we say they do. This has not happened. (And, BTW, it must not happen, ever, just in case that’s not clear.)

Since “a well regulated militia [is] necessary to the security of a free state”, where is the militia? Without it Arizona, Colorado, Missouri, Florida and the others cannot be secure. Are we doing our part to support the II? Because, if not, when the II is abolished, it will not be because the II failed, it will be because we did.

Mr. O’bama, will there ever be any Jobs?

It is time to clean house (and Senate) of all these big spending’ high rollers we have in Washington. They are the problem and the reason we are in debt. Every time they want to raise the debt ceiling, they cry if we don’t we won’t be able to pay social security, or our our military people, or our tax refunds and a million other reasons. You never here that they will miss any of their salaries or that they can cut back on any unneeded or redundent government jobs, or our president stop taking seven million dollar vacations, it’s always the “little people” who get hurt by their greedy actions. They are the ones running up all the bills so I say arrest them all, strip them of all salaries, and send them to China and let them work off all that they owe them in their prisions. The problem with the 2nd amendment is we spend all our time TALKING about it and not USING it. I know why the 2nd amendment was instituted and so does OBAMA and it scares the hell out of him and the rest of the politicians. Just think if even two per cent of the gun owners were to show up in Washington one weekend ARMED, do you think we would make an impression on them then? I really think WE failed the 2nd Amendment cause I don’t think enough of us have the guts to actually fight back!

The US Government is definitely infringing on States rights. It is the responsibility of the individual States to place any restrictions on the 2nd amendment or any amendment for that matter. The Militias of each State can bear some responsibility if they were organised as a defender of the individual State rather than being absorbed into a national organization such as the “United States Armed Guard.”

As an example the Individual States could set up their Militia with the simple ruling that all individuals who are the owners of assault weapons (Being identified as such) automatically become members of the State Militia, their names recorded as such and their names will be on a States Register as members of the Guard and in noway have is The United States to be privy the information for the vary essence of that information is in reality giving aide to a possible enemy of the States Rights

We have failed as a Nation , with our morals. As Christian Israel , we was given this land by Jehovah , his approval was with his people. Christian Israel , became lost to Gods Laws and commands . Here’s the problem: the guns aren’t keeping the government afraid of the people. Oddly the countries where the government is afraid of the populous (France, Italy, Greece, etc) have few guns.

Morals also have nothing to do with the gun violence. Most mass murders have been performed by self proclaimed followers of a god and religion; I can’t recall any mass murders committed in the name of Atheism, since Atheists are usually very peaceful.

Strangely the teachings of JC would indicate against owning or using guns, as witnessed by him not even raising a voice in opposition to his oppressors. According to Christianity it is better to die a peaceful person than commit violence; so why do so many religious followers own guns in the name of their god?

While I do think you are on the right track that a government should fear its people, the entirety of your argument makes no sense. The solution to gun violence lay elsewhere.

The Second Amendment has not failed, the Presidents and the people have failed. Had President Thomas Jefferson had President John Adams, Chief Justice Marshall and the members of Congress that voted for the Alien and Sedition Acts hanged in Lafayette Square for treason, we might not be in this mess now. Had President Andrew Jackson requested Congress issues “Letters of Marque and Reprisal” against sitting members of the Bank of England after the attempt on his life, we might not have this problem, now. Had concerned citizens from the North and South hanged Lincoln and his “Radical Republicans” for treason instead of states seceding and creating the Confederacy, we would not have this problem now. That was the turning point and now it may be too late to restore our Constitutional Republic. It certainly is without removing the Federal Reserve and Central Banks of other nationals, as well as the traitors in our government.

I wish my sincere friends would stop saying that “the Second Amendment” GIVES US THE RIGHT to keep and bear arms. IT DOES NOT GIVE US that right–it acknowledges that we already have that God-given right and it guarantees that our government can not and will not take that right from us. Our Constitution does not GIVE us the right to life, liberty, and the pursuit of happiness–it acknowledges that these things come from our Creator. It’s the same with our right to keep and bear arms. Think: If the government can GIVE us something, it can TAKE IT BACK.
