Obama’s Executive Orders in Defiance of the Constitution

In the midst of the gun control debate, as well as the arguments over the national debt, there is the chance Obama might bypass Congress and instead rely on Executive Orders to push forth his agenda.

Joe Biden is recommending that Obama issue gun control regulations via Executive Order. Biden met with pro-gun and anti-gun groups in the past few days in an attempt to work out a solution. While meeting with the pro-gun groups, I wonder if he tried to rely on the same bizarre behavior he used in the Vice Presidential debate with Paul Ryan.

“disregard for the Constitution.” applies as well to the Republicans that are letting him do so. As long as he can ignore the Constitution and keeps getting away with it he will continue to do so establishing a dangerous precedents for others to follow. The need for Congressional intervention is at hand to stop his abuse of Presidential powers.

An Executive Order by the President to ban guns or it’s sale of them would bring on an nationwide revolt and he knows that as being a former (half a**) assistant law professor or associate professor. I personally welcome the challenge am I am almost positive he would impeached and run out of office.

  The power of Executive Orders applies only to those under the authority of the president and does not apply to any U.S. citizen outside that authority. ie. Federal employees, the military etc. The president cannot MAKE LAWS. He is, however, charged with enforcing laws passed by Congress.
  Today, first and foremost IMMIGRATION laws and those protecting the sovereignty of this country. That means he MUST enforce those laws including deportation or he is at least in violation of his oath of office.
  That also means he does NOT have the power to surrender the authority of Constitutionally enacted laws to the UN!
  He has usurped the office of president and now he sounds like he wants to usurp the powers of Congress as well. Can you spell “DICTATOR”?

Let me perfectly clear. Obama hasn’t gotten away with anything, that CONgress hasn’t allowed him to get away with. CONgress is the ONLY branch of government, Constitutionally authorized to make laws. The President can issue EOs. To “do” things, such as disaster relief. He has no legislative authority.

It is the responsibility of CONgress to keep the President in check.

If obama issues an EO that is considered to be “law”, then EVERY member of CONgress should immediately vacate their offices and pay, as they are no longer
needed.

IF CONgress does not do their job, and give obama legislative power, then there is no further need for a CONgress. They will have shown us exactly how useless they are and put themselves out of a job.

Until you can show me anywhere in the U.S. Constitution where it reads the President has legislative authority, don’t bother arguing!!!

Read Article 1, Sction 1;

“All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”

Congress has ALL (100%) of the power to make ANY U.S. Laws, as is clearly specified in the very first sentence of our Nation’s ultimate legal document.

Section 1 is a vesting clause, granting all the federal government’s legislative authority to Congress.

Similar vesting clauses are found in Articles II and III, which grant “the executive power” to the President and “the judicial power” to the federal judiciary. In legal garb, the working definition of “herein” connotes specificity and exclusivity.

The Vesting Clauses thus establishes the principle of separation of powers by
specifically giving to each branch of the federal government only those powers it can exercise and no others.

  You are correct, BUT, when a sitting “president” feels he is above the law AND the Constitution, he will sign executive orders as if they were pop corn balls! He really thinks he, and he only, has the authority to pass laws—Congress, to Obama, is only a minor “bump in the road,” to be bypassed as often as possible.
  He has NO respect for the Constitution, nor Congress, and definitely NOT for the American people!

  When you look at the violence numbers according to nationality, African countries are the most violent, corrupt countries in the world. It is not racist to point our how much violence black are involved with. Black against white violence is a serious problem in America.     It’s not just African countries. According to the FBI, over 90% of all violent inter-racial crime is committed against whites by blacks. Over 93% of all violent crimes against blacks is committed by blacks.

      You are right. I just didn’t have the numbers and didn’t want to presume. Yes, the Muslim countries are also very violent. The most violent is where they are black and Muslim. When I said African I was including North Africa which is mostly Muslim. Yes, and you are also right, the greatest cause of death for young black men is other young black men. What does that say about them that they even hate their own.

I would think that by now, we know the direction Obama is taking us. Why are we letting this Illegal/Muslim/Fraud, do this to America? What has our congress been doing besides NIL/Zilltch? This arrogrant/Muslim, must be taken out, fined heavily, & JAILED for his many TREASONOUS actions against the U.S. Nixon was shamed into retirement for studip reasons, but certianly nothing in a treasonus matter, like this angry muslim.     I consider it a bit weird the Founding Fathers actually foresaw this entire scenario, and tried valiantly to warn us against it, but, we sailed into the jaws of communism, socialism and Marxism with eyes wide open, and didn’t even try to back away—too much permissiveness, I think, too much social thinking–that got off track from the goodness and hope of the thinkers. It is strange how the words of our Forefathers ring so true these days.

      When the founding fathers were creating a utopia of sorts, except that the people were able to make decisions good or bad, communism didn’t exist. Communism creates a different utopia, the government makes the decisions and whether they are good or bad the people have to accept them. What we have now is a system between democracy and communism, it’s kind of like the government will let you make a decision but if it’s wrong then the government will make it for you, You didn’t build that company the government helped. Your money doesn’t really belong to you, it belongs to the government. So don’t work hard, the government will provide. That is not what our founding fathers wanted, and as long as people continue to get their goodies then socialism prevails. It seems like people are not really concerned about jobs as much as I thought.

When they say “take away our guns” does that also mean without compensation? I believe that is illegal seizure which is also protected under the 4th amendment. So now it is the 2nd and 4th amendment that is in jeopardy. This president wants to “protect the children” by giving them an unsustainable debt and a tattered constitution?
