FIGHTING JIHADIS: This UNUSED Legal Tool Is ALREADY On The Books… Leftists Will HATE It!

In the midst of the debate over the Donald’s Executive Order banning visitors from seven Muslim countries (Iran, Iraq, Libya, Somalia, Sudan, Syria, and Yemen), there are a couple of factors one should take into consideration. The first factor would be that legislation with similar language was passed during the Obama Administration. Such legislation (as part of an omnibus spending bill) was the Visa Waiver Program Improvement and Terrorist Travel Prevention Act. Such legislation restricted access to the Visa Waiver Program, which allows people from 38 nations who come to the United States for a period of less than 90 days to enter without a visa. The bill was signed into law in December 2015, and applied to the same seven countries.

There was hardly any fuss over this law, but that was because there was a Democrat in the White House. Thus, the Left has again demonstrated its hypocrisy. I should add that in addition to keeping jihadists out of America, this law will also bar any advocates of Sharia Law from entering America.

Which brings me to the second factor- the Immigration and Nationality Act of 1952 (a.k.a. the McCarran-Walter Act). This law had several provisions, which consisted of the following: eliminating racial restrictions from previous immigration laws by means of a quota system for various nationalities and regions, defining three types of immigrants (which in turn consist of immigrants with special skills or relatives of American citizens exempt from quotas and thus were to be admitted without restrictions, average immigrants whose numbers were not allowed to exceed 270,000 each year, and refugees), and expanded the definition of what the United States was, i.e. providing American citizenship at birth to those living in Guam (for individuals born on or after December 24, 1952 to be exact).

In addition to these provisions, the McCarran-Walter Act authorizes the government to deport immigrants or naturalized citizens engaged in subversive activities as well as banning suspected subversives from entering America. Although intended to target Communist subversives (e.g. prohibiting Communists, former Communists, and the Communist Party’s fellow travelers from entering the United States), the McCarran-Walter Act apparently applies to all immigrants, which would include terrorists and those of other ideologies who seek to overthrow the government of the United States. Thus, it applies to jihadists and those who want to introduce Sharia Law (and hence turn America into an Islamic State).

So the next time you hear someone mentioning the Islamization of America, tell them about the McCarran-Walter Act (especially if that individual is an advocate of Sharia Law).
