McCloskeys Indicted By Grand Jury — This Is Your Reminder That 2A Is On The Ballot

The St. Louis “gun couple” made famous in a viral video has been indicted for exercising their right to bear arms.

Mark and Patricia McCloskey were each issued one count of exhibiting a weapon and one count for tampering with evidence related to the confrontation with protesters that broke into their gated community at the end of June.

Grand jurors found probable cause on both counts, the second of which involves Patricia McCloskey’s pistol, which was turned over to police in July, according to reports…

…Kimberly Gardner, the city´s chief prosecutor, filed felony unlawful use of a weapon charges against the couple in July before bringing the case to a grand jury, which indicted the couple on unlawful use of a weapon and tampering with evidence felonies, their attorney said.

‘It is illegal to wave weapons in a threatening manner at those participating in nonviolent protest, and while we are fortunate this situation did not escalate into deadly force, this type of conduct is unacceptable in St. Louis,’ Gardner said in a statement when she filed charges.

Gardner has refused to charge the protesters that broke into the area and were trespassing.

No one was injured, and neither of the McCloskeys fired a shot.

It should be noted that the McCloskeys did indeed feel threatened because the crowd was shouting threats at them. You’d think that leftists — who rationalize things with feelings rather than facts — would sympathize with the McCloskeys after hearing that someone in the crowd threatened to rape Patricia McCloskey and there were some carrying their own weapons at the time. But then, facts don’t seem to matter.

As Mark McCloskey said, there are Democrat prosecutors out there that will protect the criminals and go after honest citizens.

Think about that for a second — prosecutors are willing to let angry mobs trespass on private property because they ascribe to the same leftwing viewpoint, but will go after legal gun-owners for wanting to protect themselves. It’s shameful.

It’s bad enough that the McCloskeys are being indicted in a state with a robust “Castle Doctrine” provision, but adding the “tampering with evidence” is just insult to injury.

When questioned by the police in July, Patricia McCloskey said that the pistol that she pointed at protesters had been inoperable because she used it as a prop in a trial against a gun manufacturer. The firing pin was misplaced so that the gun couldn’t discharge, and that was the state that the pistol was in on that late June confrontation with protesters and when she turned it over to police.

The disgusting thing is that it appears that the District Attorney had the crime lab reassemble the gun so that it is now operational… and now the McCloskeys are being charged with tampering with the evidence.

Documents obtained by 5 On Your Side in July showed Gardner’s Assistant Circuit Attorney Chris Hinckley ordered crime lab workers to reassemble the gun so it could be fired.

Missouri law states that a gun must be ‘readily capable of lethal use’ in order for someone to be charged with unlawful use of a weapon.

Hinkley later wrote in a criminal complaint against Patricia McCloskey that the weapon was readily capable of lethal use.

Schwartz said at the time that it was ‘disheartening to learn that a law enforcement agency altered evidence in order to prosecute an innocent member of the community.’
