Chuck Grassley, chairman of the Senate Judiciary Committee, said a Supreme Court justice could resign as soon as this summer.
Of the existing Judges, Kennedy and RBG are the oldest.
“I would expect a resignation this summer,” the Iowa senator said, according to the Muscatine Journal. Grassley’s comments came during a Q&A at a visit to Kent Corporation in Muscatine, Iowa.
Without naming a justice, Grassley said an upcoming resignation is “rumored.”
The oldest justices on the court are Ruth Bader Ginsburg, 84, Anthony Kennedy, 80, and Stephen Breyer, 78.
If a resignation did happen, President Trump would likely nominate a conservative judge as a replacement, tilting the court even more to the right. — ABC
CNN — just this month — was anticipating Justice Kennedy’s retirement.
Justice Kennedy, 80, has been mulling retirement. Former law clerks and others close to him say he is privately vowing to step down in the next few years. The centrist conservative is the court’s most vacillating, agonizing, justice, and he is likely balancing his oft-voiced sense of judicial mission with the realities of age.
Whether he will leave this summer when the current term ends, or continue serving, is not easy to predict. But it will matter.
Kennedy has cast the decisive vote on high-profile cases for more than a decade, upholding abortion rights, ensuring campus affirmative action, and declaring the constitutionality of same-sex marriage. In recent years, he has moved to the left on racially inflected disputes, casting the key fifth vote for broad federal coverage against housing bias in 2015, and new constitutional protection against racism in jury deliberations just this March.
If either He or Ruth Bader Ginsberg were to step down during Trump’s term? And if Trump nominates another name from his list?
That would go a long way toward stabilizing the Court from being a tool the political left uses to force their will on America.
