She’s setting out to prove that Americans still have rights — even if they live in the 9th Circuit.
She’s challenging the ‘no logo’ policy of her school they invoked to prohibit her wearing the hat. (There was a shirt, too.) She’s suing the school for violating her First Amendment Rights.
Clovis North High School senior Maddie Mueller is a member of Valley Patriots. The conservative activist group asked its affiliates to wear the well-known hat bearing President Trump’s campaign motto on Wednesday. Mueller said officials at the Fresno school told her the school dress code prohibited it, according to CBS affiliate KGPE.
Now, Mueller is fighting the district.
“To my knowledge Trump is not a logo; it’s a last name. It’s just our president. You can’t claim the president is a logo, sports team or affiliated with any gang,” she told KGPE. “How does being a patriot in trying to show pride in your country — how is that inappropriate?”

They really stepped in it this time. Not only should she free to wear the hat, but wearing it was part of a political protest. They are infringing on her right to peaceful protest.
Have they already forgotten that schools have already lost such lawsuits? What is the school’s rationale? First, they’re probably counting on the 9th Circus. (Thank YOU, Jeff Flake, for blocking those nominations as your last act of defiance).
“Bottom line for us is the dress code is for kids to feel safe at school and free of distractions so they can focus on learning.” said CUSD spokesperson, Kelly Avants.
“Here we are closer to shouting fire in a crowded theater.”
Former federal district judge Oliver Wanger says the student’s first amendment right is being stripped but the district may have the right to do so.
“If the hat is something that could invoke violence or invoke controversy, then for the sake of the safety for students the school is in their legal right.”
