Presumption Of Guilt: Senator Says She Wants To See ‘Evidence Of The President’s Innocence’

That’s not how this works in the United States of America.

It also violates Article 11 of the Universal Declaration of Human Rights, which states, “Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.”

But, are we really surprised that Democrats are pushing aside the presumption of innocence? This is precisely what they did with the confirmation circus when Justice Brett Kavanaugh was accused of sexual misconduct, some of which was completely ludicrous and other accusations had zero proof — either with evidence or witnesses — when tested.

Senator Tammy Duckworth(D-IL) was clear that she believes in the presumption of guilt with regard to President Trump rather than the precious presumption of innocence that is the cornerstone (or at least should be the cornerstone) of our justice system. In an appearance on Fox News, when asked if some Democrats were going to vote with Republicans to end the impeachment trial, she told Bill Hemmer, “I think that we should be able to see evidence of the President’s innocence.”

Geez. No wonder these guys are going full-commie! The presumption of guilt is something that those authoritarian socialist regimes love. It’s much easier to maintain a “democratic” socialist country that way — just incarcerate dissidents on fabricated charges and have them “prove” their innocence. (After all, gulags are a good thing, comrade.)

Isn’t that what they’re doing with President Trump? Democrats did not prove their case, held back exculpatory evidence, and tossed aside Due Process with their “House rules.”

Does Sen. Duckworth not know that the burden of proof rests with the prosecution and not with the defense?

But then, having President Trump “prove” his innocence is a Democrat talking point.

We saw that with Speaker Pelosi in November…

…and House Majority Leader Steny Hoyer in December:

And again by Rep. Raskin(D-MD) in the House Rules Committee Hearing on the impeachment process.

And again with Senate Minority Leader Chuck Schumer(D-NY) just days ago when discussing the need for witnesses:

Here’s the thing — the House Democrats have called 18 witnesses, 1 of which was sequestered because the testimony is believed to have provided exculpatory evidence for the President. The House Republicans have had no exclusive witnesses. Even Jonathan Turley and the other Republican witnesses were also on the list of Democrat witnesses. The Democrats pushed forward anyway and impeached the President.

So, when the Democrats harp on the “need for witnesses” recognize it for what it is — a talking point. They don’t really care about justice and a fair trial, they didn’t allow Republicans to call witnesses in the House Hearings.

Just moments ago, Speaker Pelosi said that even if the Senate votes to acquit President Trump, he won’t be acquitted because it wasn’t a trial because there were no witnesses.

So, I guess he wasn’t impeached, then. The Republicans were not permitted to present a proper defense.

Sure, it might look bad to end the Senate hearing without witnesses, but the whole damned thing is a sham anyway. Democrats are going to cry foul no matter what because there are not 67 votes to remove Trump from office. It’s also a great way to keep the Senate too busy to confirm federal judges as has been going at a dizzying rate that has Democrats freaking out.

The courts are what this is all about. It’s always about the courts.

With the Democrats tossing out due process, the presumption of innocence, and the rights of the accused, it’s clear that they prefer the authoritarian kangaroo courts to legislate from the bench instead of having judges rule in accordance with the law and the Constitution. They did that with Title IX on college campuses, and they’re doing it with President Trump’s impeachment.

How long before they make it the norm?
