If the DOJ thought that they could buy some more time by having SCOTUS block implementation until after the case winds its way through to a final verdict, they were mistaken.
Just because you have a pen and a phone, doesn’t mean you can do whatever the hell you want. There are still laws and procedures by which even Biden is bound. And the courts were happy to remind him of that fact.
This will be a bitter pill for everyone who endlessly decried Trump’s policies as ‘illegal’ and fought them in the courts. When actually tested in the courts, a pattern is already emerging of Trump’s policies standing up, and Joe’s getting shot down as either unconstitutional or illegal.
The Justice Department asked the court late last week to delay reinstatement of the policy, known as “Remain in Mexico,” arguing in its brief that the policy had been dormant for more than a year and that abruptly reinstating it “would prejudice the United States’ relations with vital regional partners, severely disrupt its operations at the southern border, and threaten to create a diplomatic and humanitarian crisis.”
A lower court had ordered the reinstatement of the program, forcing the administration to appeal to the Supreme Court.
The policy was meant to discourage asylum-seekers, but critics argue that it denies people the legal right to seek protection in the U.S. and forces them to wait in dangerous Mexican border cities. It requires asylum-seekers to remain in Mexico until their court dates in the U.S., and it previously left tens of thousands of Central American migrants waiting in tent cities in places like Matamoros, Mexico, where they were often subjected to robbery, kidnapping and assault.
…Attorneys general in Missouri and Texas sued the Biden administration to reinstate the policy, claiming that the high number of asylum-seekers was burdening states without DHS’s being able to detain them. Texas and Missouri also argued that the Biden administration had not gone through proper administrative procedures in ending the policy.–NBC
We can’t help but notice the irony that NBC reporting goes out of its way to highlight the crime risk faced by people waiting in Mexico, but can’t recognize the corollary crime risk of unvetted border jumpers coming here FROM Mexico (and sundry other countries beyond) poses on both American citizens and lawful immigrants quietly living out their lives in America.
For context, in his last official communication upon his retirement, the Border Patrol chief had this to say about known terrorists exploiting our open border:
Amid a massive surge of migrants at the United States-Mexico border, the outgoing Border Patrol chief told his 19,000 agents prior to retiring over the weekend that known or suspected terrorists are coming into America “at a level we have never seen before.”
“Over and over again, I see other people talk about our mission, your mission, and the context of it being immigration or the current crisis today being an immigration crisis,” Rodney Scott, who retired Saturday, said in a video to employees.
“I firmly believe that it is a national security crisis. Immigration is just a subcomponent of it, and right, now it’s just a cover for massive amounts of smuggling going across the southwest border — to include TSDBs at a level we have never seen before. That’s a real threat,” he said.
The term “TSDB” is a reference to the Federal Bureau of Investigation’s (FBI) Terrorist Screening Center Database. The database is used by government agencies and launched after the attacks of September 11, 2001. —Federalist
Good for the States that took a stand protecting their regional interests against Joe’s cynical agenda. It will take a strong stand by the states and a cultural shift back toward Federalism to pull the brake on the Biden Administration’s profligate runaway train.
