Nunes Wins Another Court Battle In Fight To Hold Fake News Accountable

As a California conservative, Nunes had a target on his back from day one. In exposing Crossfire Hurricane for the conspiracy it was… he was absolutely hated by the press.

Their reporting reflected that bias.

Time and again, the press had egg on its face after defending the indefensible lies spun by Adam Schiff, while one by one, the claims and allegations made by Devon Nunes turned out to be entirely accurate.

Even without the truth on their side, there are plenty of ways the press can make life hell for someone they don’t like.

Until recently, there wasn’t much they could do about it.

What happens when a highly-partisan press has biases that are not backed up by facts? There are still plenty of options left to them. The framing of stories to make innocent events look sinister is one option. Just ask Larry Elder about that one: L.A. They can print unproven allegations as though they are fact. Remember the name Jussie Smollet? What about the NASCAR guy who found a ‘noose’ tied in the string of his garage pull?

You can leave out exonerating details that would flip the claims of the story on their heads — the ‘Very Fine People Hoax’ would fall apart if the so-called ‘journalists’ had played the next 50 seconds or so of audio where Trump explicitly said, ‘I’m not talking about the neo-Nazis& the white nationalists because they should be condemned totally.’

Because of how courts had ruled on the press having wide latitude in what critical things they write about public persons, coming after them for defamation was a longshot.

Until Nick Sandmann came along, and took the press to the cleaners. The joke was that Nick became the highest-paid employee of some of these companies.

Devon Nunes has taken the press to court.

He just scored another political win in which his defamation case advanced.

Congressman Devin Nunes’ lawsuit against Hearst Magazine Media and one of its journalists can move forward, the U.S. Court of Appeals for the Eighth Circuit ruled Wednesday, pointing to a tweet the journalist made after the complaint had been served as basis for reviving the litigation.

Nunes, R-California, sued the media company in 2019 over an article written by reporter Ryan Lizza for then Hearst-owned Esquire magazine about the Nunes family’s dairy farm in Sibley, Iowa. Nunes claimed the article, titled “Devin Nunes’s Family Farm Is Hiding a Politically Explosive Secret,” falsely implied that he and his family kept his relatives’ move from California to Iowa in 2006 a secret, and hid the farm’s use of undocumented labor.

…The judges wrote that when Lizza retweeted the article two months after the lawsuit was filed, that constituted republishing the story to a new audience while he was on notice of the alleged defamation implications and could potentially establish “actual malice.” They pointed to specific language in the tweet, including Lizza describing the story as “a strange tale.” —Law

Nunes filed another defamation suit against the Washington Post and one of its reporters in 2020 over an article, which was later corrected, that included a statement about the representative believing Obama administration officials spied on Trump Tower in 2016. Last month, U.S. District Judge Carl Nichols of the District of Columbia ruled that the suit can survive a motion to dismiss from the paper’s lawyers with Williams & Connolly. —Law
