The Democrat Governor just learned a hard lesson in the use of power. Any regulation is only as good as your ability to enforce it.
As for the Emergency Health order, the Governor quickly learned she has NO ability to enforce it.
She might be more than happy to blow off her oath to the Constitution, but the fellas with badges and the responsibility for enforcing the law? Not so much.
Bernalillo County Sheriff John Allen was not consulted on the Governor’s plan, was not given any advance notice about it, and will not be playing any role in enforcing ig.
Allen described the order as unconstitutional and said he learned about the order just minutes before the announcement last week. The public health order was issued after an 11-year-old boy was killed in Albuquerque.
“The governor made it clear in her press conference,” Allen said. “She knew we as law enforcement did not agree with the order, and as a result, this was solely her decision.”
He went on to say that this order will not assist him in making the county safer for the public or his policing staff.
“This order will not do anything to curb gun violence other than punish law-abiding citizens from their constitutional right of self-defense,” Allen said. — KOAT
NM District Attorney Sam Bregman said that he, as with Albuquerque Mayor Tim Keller and Police Chief Harold Medina, would not enforce the ban:
