Merrick Garland tried desperately to duck these questions, but Massie was having none of it.
Like so many of Biden’s appointees when they go for Congressional Hearings, Garland is more interested in playing Rope-A-Dope and running out the clock than he is in giving serious and responsive answers to the people who have Constitutional authority of exercising oversight over his actions.
But Massie found a way to slip past Garland’s slippery evasiveness and got him to answer some uncomfortable questions about the man appointed to be ‘special counsel’ investigating Donald Trump.

There are several lines of legal reasoning claiming that, since Jack Smith never went through the Senate confirmation hearings, he lacks the proper authority to exercise any of the powers he has invoked as a special prosecutor. More than that, there are questions about what legal statute he even operates under as a ‘special prosecutor’ or what justification the DOJ has for allocating funds to that purpose.
Those are questions soon to be reviewed by Judge Cannon in the Trump documents case… depending on the result, they could throw the case out completely.
