It’s The Constitution….Stupid

Constitutional Crisis, they keep saying that word. Do they really know what they are saying?

Everything that President Trump has accomplished and is still working on is being regarded as the next big Constitutional Crisis by the sky screaming Demsheviks, with the help of what passes for journalists.

As with their overuse of words like “hate” and “racist”, it’s hard to understand if they even know what they’re talking about. You can incorrectly overuse a word to the point where it loses its meaning. I believe that’s where we’re at with ‘Constitutional Crisis’.

Okay, then, so what is actually perceived as a “constitutional crisis”? By definition, it’s a problem or conflict in the function of government that the political constitution or other fundamental law is perceived to be unable to resolve. It’s that point where the system of checks and balances and framework of resolving issues breaks down.

Examples are any branch of government defying or disregarding law; a situation where the Constitution itself doesn’t offer clear guidance; or a complete failure of any government institution to uphold the law and attempts to work outside of its expressed purpose. Regarding this last line, we’ve seen a plethora of examples uncovered by DOGE of government agencies funneling taxpayer dollars to support anything except American citizens’ interests. The use of the USAID agency as a sort of slush fund for whatever the Demsheviks felt was more important was way outside the agency’s so-called mission, which is stated as “to partner to end extreme poverty and promote resilient, democratic societies while advancing American security and prosperity.”

A Constitutional Crisis also involves the breakdown within the entire system; defiance towards Constitutional provisions; and the erosion (in fact, the erasure) of all norms and practices that enable the Constitution to function in the first place.

There is no exact legal definition of what a Constitutional Crisis is. However, with escalating tension within the whole of government, trust and even the willingness to resolve issues gets lost in the rhetoric. And, unfortunately, this scenario can include all branches of government, right down to the state level.

This makes understanding a Constitutional Crisis almost purely subjective. The idea of such a crisis can, and has, been used as a battering ram by each side against the other side.

It’s this subjective nature that makes it hard to look at the historical record of every president to see who exactly either created a crisis or had to deal with one. The best historical examples, though, are the following:

Lincoln: the Civil War was definitely a major Constitutional Crisis; he also suspended the writ of habeas corpus in 1861 without congressional approval

Jackson: had issues with the balance of power regarding the Nullification Crisis and the Bank War

FDR: his attempt to pack the Supreme Court, plus his unprecedented four terms, which is the reason we have the Twenty-Second Amendment

Nixon: Watergate and the overuse of executive privilege

Clinton: his impeachment trial

This brings us to President Trump. His challenging the results of the 2020 election did bring on a Constitutional Crisis, which rightfully has yet to be resolved.

What he has done now, especially with DOGE and his handling of the open border invasion, has been called “Constitutional Crisis”, but are they really? Let’s look at a few sections of the Constitution.

In regard to unregulated spending, Article 1, sec. 9 says the following: “No money shall be drawn from the treasury but in consequence of appropriations made by law; and a regular statement and account of the receipts and expenditures of all public money shall be published from time to time. ”

It’s not a Constitutional Crisis to find out where the money is going and to stop the wholesale embezzlement of tax dollars.

In regard to President Trump’s shutting down the border and initiating deportations, and in regard to the authority of the office of the President, Article 2, Section. 3 simply says: “He shall take care that the laws are faithfully executed, and shall commission all officers of the United States.”

Immigration law is the law, in spite of the Demsheviks. I’m not sure if the “commission all officers” part would apply to his working with Musk, but this part of the section doesn’t specify what constitutes an “officer”. I’m going to guess that some legal scholars would say it would.

President Trump himself has been the victim of a Constitutional Crisis. New York AG Letitia James sued him for over $400 million in regard to his several business evaluations. This goes against the 8th Amendment, which states: “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. ”

There’s a lot more we could go into, but space doesn’t allow for it here. I do eventually want to take a good look at the 25th Amendment and how Biden was removed from running for a second term. Lots of interesting stuff there. For now, though, let’s just really pay attention whenever the Demsheviks start yelling “Constitutional Crisis” every time the rule of law is actually followed. Remember, these are the traitorous miscreants who constantly yammer about “our democracy”, forgetting we’re a Constitutional Republic.

Yeah, it really is the Constitution… stupid.
