With a Clinton-appointed judge dismissing the case against Comey on a technicality because Dems have been actively obstructing Trump appointments to the DOJ, Comey is grinning. For now, at least.
We have long since learned that Jim Comey is a stilleto-weilding creature of the swamp who can (and will!) use any tool at his disposal to achieve a desired outcome.
This is precisely the feature of his personality that left him facing the criminal charges that put him back in the national spotlight for his role in planning, executing, and later obstructing investigations into the chicanery of Crossfire Hurricane. He assumed his actions would never be known, or if they did, it would be long after anything could be done about them.
That miscalculation left him facing criminal charges. So he got himself a high-priced lawyer and fought the charges on a technicality of whether that particular AG had any right to do the job.
A sympathetic judge threw out his case, and Letitia James’s with it.
So Comey got off Scott-free. Again.
Or did he?
He and Letitia James may want to leave the corks in those champagne bottles just a little while longer until the process plays out.
Pam Bondi is challenging this dismissal, and there is a non-trivial chance her argument will hold up.

The dismissal of both cases rested on a claim that Lindsey Halligan was improperly appointed as interim US Attorney for Virginia. Former DoJ Chief of Staff Chad Mizelle made this observation:

The part in yellow reads, “As explained below, I agree with Mr. Comey that the Attorney General’s attempt to install Ms. Halligan as District Attorney for the Easter District of Virginia was invalid. And because Ms. Halligan had no lawful authority to present the indictment, I will grant Mr. Comey’s motion and dismiss the indictment without prejudice.”
Leaving aside the stalling and obstruction tactics the GOP has tolerated from the Democrats blocking Trump’s appointments, (a problem that still needs to be addressed) the appeal will remind the courts that this as been authorized not just by Ms Halligan, but by the AG herself.
If an indictment signed by the Attorney General is not sufficient to make it official and valid, what more would it possibly take?
