DOJ Confronts Denver… Slapped With An Order Protecting 2A Rights

Denver doesn't get to pick and choose which rights apply to a US citizen in their city

Anti 2A activists may have been having a field day in blue strongholds, but under Trump, those days are over.

Under Trump, the Second Amendment is once again being given its proper place as a Constitutional right that ‘shall not be infringed’.

That doesn’t JUST mean that gun owners in red states can expect to see their 2A rights upheld, but even those blue states with a strong desire to curtail those rights will have to limit their agenda to within limits permitted by the Constitution itself.

The city of Denver just received a ‘cease and desist’ letter from the DOJ for laws on their books that are out of step with the Constitution.

Since Denver isn’t planning to back down, this will be setting up a confrontation in the courts about the extent to which blue cities can curtail gun rights.

Trump’s DOJ sent a letter to Denver’s leadership last week, calling on them to repeal an ‘assault weapons’ ban they have had on the books for 37 years — or else see them in court over it. Local news indicated Denver has no intention of blinking.

The DOJ warned of a possible lawsuit if Denver does not repeal the ban, which restricts guns with magazines over 15 rounds, including AR-15-style firearms—a gun that the DOJ letter claims is the “most popular rifle in America.”

“The Ordinance bans many weapons, including AR-15 style semiautomatic rifles. Law-abiding Americans own and use for lawful purposes literally tens of millions of AR-15 style rifles. Indeed, it is the most popular rifle in America. The City has banned an arm in common use for lawful purposes by law-abiding citizens. Therefore, the Ordinance violates the Second Amendment,” the DOJ letter reads.

In response to the DOJ’s demand, Denver leaders, including Mayor Mike Johnston, rejected the ultimatum, asserting that the federal government is overreaching and defending the city’s position. — Denver7

Both sides of the issue point to earlier cases they see as evidence that their side will prevail in court. The DOJ’s citation of common use for the most popular rifle in America will square of against an earlier win (with prejudice) in which the prohibitionist side enforced magazine capacity laws.

The pleasant difference in this instance is the fact that the DOJ is arguing alongside the 2A rights advocates and not the prohibitionists.
