CHILLING: Legal Memo from Obama DOJ Justifies Assassination of US Citizens

The most extremist power any political leader can assert is the power to target his own citizens for execution without any charges or due process, far from any battlefield. The Obama administration has not only asserted exactly that power in theory, but has exercised it in practice. In September 2011, it killed US citizen Anwar Awlaki in a drone strike in Yemen, along with US citizen Samir Khan, and then, in circumstances that are still unexplained, two weeks later killed Awlaki’s 16-year-old American son Abdulrahman with a separate drone strike in Yemen.

Since then, senior Obama officials including Attorney General Eric Holder and John Brennan, Obama’s top terrorism adviser and his current nominee to lead the CIA, have explicitly argued that the president is and should be vested with this power. Meanwhile, a Washington Post article from October reported that the administration is formally institutionalizing this president’s power to decide who dies under the Orwellian title “disposition matrix”.

When the New York Times back in April, 2010 first confirmed the existence of Obama’s hit list, it made clear just what an extremist power this is, noting: “It is extremely rare, if not unprecedented, for an American to be approved for targeted killing.” The NYT quoted a Bush intelligence official as saying “he did not know of any American who was approved for targeted killing under the former president”. When the existence of Obama’s hit list was first reported several months earlier by the Washington Post’s Dana Priest, she wrote that the “list includes three Americans”.

What has made these actions all the more radical is the absolute secrecy with which Obama has draped all of this. Not only is the entire process carried out solely within the Executive branch – with no checks or oversight of any kind – but there is zero transparency and zero accountability. The president’s underlings compile their proposed lists of who should be executed, and the president – at a charming weekly event dubbed by White House aides as “Terror Tuesday” – then chooses from “baseball cards” and decrees in total secrecy who should die. The power of accuser, prosecutor, judge, jury, and executioner are all consolidated in this one man, and those powers are exercised in the dark.

In fact, The Most Transparent Administration Ever™ has been so fixated on secrecy that they have refused even to disclose the legal memoranda prepared by Obama lawyers setting forth their legal rationale for why the president has this power. During the Bush years, when Bush refused to disclose the memoranda from his Office of Legal Counsel (OLC) that legally authorized torture, rendition, warrantless eavesdropping and the like, leading Democratic lawyers such as Dawn Johnsen (Obama’s first choice to lead the OLC) vehemently denounced this practice as a grave threat, warning that “the Bush Administration’s excessive reliance on ‘secret law’ threatens the effective functioning of American democracy” and “the withholding from Congress and the public of legal interpretations by the [OLC] upsets the system of checks and balances between the executive and legislative branches of government.”

But when it comes to Obama’s assassination power, this is exactly what his administration has done. It has repeatedly refused to disclose the principal legal memoranda prepared by Obama OLC lawyers that justified his kill list. It is, right now, vigorously resisting lawsuits from the New York Times and the ACLU to obtain that OLC memorandum. In sum, Obama not only claims he has the power to order US citizens killed with no transparency, but that even the documents explaining the legal rationale for this power are to be concealed. He’s maintaining secret law on the most extremist power he can assert.

Last night, NBC News’ Michael Isikoff released a 16-page “white paper” prepared by the Obama DOJ that purports to justify Obama’s power to target even Americans for assassination without due process (the memo is embedded in full below). This is not the primary OLC memo justifying Obama’s kill list – that is still concealed – but it appears to track the reasoning of that memo as anonymously described to the New York Times in October 2011.

This new memo is entitled: “Lawfulness of a Lethal Operation Directed Against a US Citizen Who is a Senior Operational Leader of Al-Qa’ida or An Associated Force”. It claims its conclusion is “reached with recognition of the extraordinary seriousness of a lethal operation by the United States against a US citizen”. Yet it is every bit as chilling as the Bush OLC torture memos in how its clinical, legalistic tone completely sanitizes the radical and dangerous power it purports to authorize.

          We should have said that Muslims were teaching each other to hate western democracies with as much vigor as communists did, and that our response should be no less lethal to them. Nation building should have been verboten; the losers can do the rebuilding.

          The only thing we don’t want to do is enter into a civil war in this country over our differing opinions on how to protect our nation, or for that matter, on any other topic.     I think the killing of traitorous enemy combatants like al-Alawki should be approved by a special court like the FISA court, but House Repubs have done nothing to pass a law enacting something like this. The feckless fools have taken 45+ votes to repeal/ defund Obamacare, but have done nothing on this issue.

      What al-Alawki preached is the same as what other extremist mullahs have said in other countries. Do we kill all of them just to keep the bar at the same level for all people? That could cause a war. Do we reserve that for only American citizens or supposed American citizens as his was in question like someone else’s.         According to U.S. intelligence, al-Awlaki was far worse than most mullahs. He was an official leader of al-Qaeda. He was devising terrorist attacks. Yemen tried him in absentia for plotting to kill foreigners and being a member of al-Qaeda.

          I am not defending al-Awlwaki even a little. What I am defending or at the very least all of us and those that do oppose us. If he was a citizen then where is the line of demarkation where the right to life is forfeit?
          As a member of AQ he did qualify as an enemy. As a citizen he was subject to our laws to be condemned or protected by them. Pushing aside those facts for the sake of convenience in order to eliminate opposition should scare us all. That is why we have those protections to avoid and deter Star Chambers as it were. Right now I can tell you that the NSA and FBI spying falls right in line with the dissolution of our rights of privacy. A secret judge okays the warrants for surveillance on trumped up say so. Imagine taking that a couple of steps further and taking a persons’ life.
          I have read your posts in the past so I am pretty sure you know what I am saying.

Certain of those among us have done these despicable things, and worse probably, and though none of us is without sin, He would not have His Holy Death be meaningless, and so those who are faithful He will care for, regardless of the shenanigans of Leftist freaks who think recreational fornication, sodomy, and baby murder are in the Bill of Rights, and therefore sanctioned by God. Those of us who adhere to the Constitution, and seek for ways to defeat the evil of the Left through persuasion and also through exampled lifestyles, and who above all adhere to His Bible, I believe He will ultimately bless; the rest goes into the fire, and good riddance … they had their chance.

            It is ultimately more important to be faithful than to be a fearsome soldier, as odd as that seems to our human reason. We are supposed to trust Him, above all … not the feeble efforts of our own hands. Our job is to stay faithful within our own lives, for we are not judged together, but separately.

            I pray that He will bless the efforts of those who fight for liberty, as He has in the past, even if they (and we) must fight in our own land. But I do not see yet that we should arm ourselves against our own government. Christian doctrine says that government is there to punish evildoers, and even Martin Luther said he would rather be ruled by a competent secular fellow than an incompetent Christian.

            These are hard questions. And we are not the first to ask them. Even the Founders were circumspect in their dealings with England.

    I’m a conservative, and I don’t like the idea of the US government ordering the death of citizens without due process. But al-Awlaki was a special case, as was Khan. It is unfortunate that Awlaki’s son was there, too, but the son was in harm’s way because of Awlaki. Awlaki’s death has a historical analogy. In 1864, Leonidas Polk, the Episcopal Bishop of Louisiana, was about a mile behind the Confederate lines when US captain Hubert Dilger saw through a telescope that there was a tent on top of a mountain with a number of high-ranking Confederate officers. “Let me just tickle them,” said Dilger, and he fired one of his 20-lb. Parrott cannon at the tent. The shell struck Polk in the head, killing him instantly.

    How could one justify shooting a churchman in the head without any trial? Very simple. Bishop Polk wasn’t just a churchman; he was a lieutenant general in the Confederate Army. At his command, US Army soldiers were being killed. He could not be arrested and tried. After all, he was behind Confederate lines and had some 20,000 men between him and the Union Army. So he was entitled to no trial, and Captain Dilger did not violate any right of Bishop Polk.

    At Awlaki’s command, US soldiers had been killed and, had he lived, more would have been killed. He had placed himself outside the reach of the United States judicial system. That missile that killed him was the exact counterpart of Captain Dilger’s shell. And if Bishop Polk’s son (if he had one) had been standing next to him at that moment, he would have been as dead as Awlaki’s son is. Awlaki was entitled to the same process Bishop Polk got.

        Again, there’s a separate factor. Awlaki, like Bishop Polk, was outside the reach of US law enforcement. If Obama were to be charged with treason, he would be entitled to an indictment process and then a trial by jury.

          matter of an upcoming deadly attack. Curious: Are there ever any circumstances
          where you might not be willing to wait for a trial? What if someone was
          breaking down your front door and you don’t know why? Are you going to wait?

            If someone is breaking down your door in most states you are allowed to fire when they enter the abode forcefully. In some jurisdictions you have to be sure their head is within the doorway.
            Outside of the the possibility that Bin Laden may have already been deceased the answer is yes if he was captured alive. As a matter of fact from all of the accounts I have read he could have been captured instead of summarily executed. However I was not on the ground and may not have all of the facts and the situation. As far as Hitler yes again. No matter the justice of just killing a murderer like these two. justice and Legality must be openly compared to the evil we fight. If we are willing to fight and die for a cause then we must by all means have those reasons re-enforced.

            I have been around for a bit and so I guess in the real world I do last a while. As far as the little slurs take them where you got them from.
            Killing people is easy in one sense; setting a standard is much more difficult and much more effective.

            too far. I never figured I’d change your mind anyway. As for me (and for many
            others commenting on this issue), I don’t like much about Obama. But in this case,
            he has my full support. Should I need reasons to complain about him, this isn’t
            one of them, there are plenty of others available. If I believe we have
            adequate information to tag someone as a terrorist (or connections with), then
            I know their goal is to either kill civilians over here, or our soldiers over
            there. That’s all I need to know, to not wait.

      I think you can rationalize any situation you want if you work at it hard enough, but I would like to remind you that General Polk died in the heat of battle (as did many other soldiers, both Confederate and Union, that day), and not, as Awlaki’s son did, two weeks later in a separate drone strike that plainly was directed against him.

      Here’s the real bottom line — when you agree that it’s okay for the President to assassinate an American citizen without public due process, you are in abject violation of the Constitution, which specifically states that no American can be “denied life, liberty or property without due process of law.” By agreeing that it’s okay in one case, you have effectively agreed that it’s okay in any case. I will never agree to that.

      If Awlaki was guilty of crimes against America, then he should have been put on trial — even in absentia (after all, he has the right to face his accusers; all he would have to do is show up at the trial). Once convicted, and assuming death was the penalty agreed upon by a jury, then by all means execute him. Failing that however, this was nothing more than a murder carried out extra-legally and without any attempt to provide due process. Heck, even taking away his citizenship would have required some form of due process and could have satisfied the requirement, but they didn’t even bother to go for that low-hanging fruit, did they?

In a nutshell, if you believe in God, Guns, and the Constitution, or have a political bumper sticker on your car the government doesn’t agree with, OR if you are a veteran of the military old or new, you are to be considered a ” possible home grown terrorist “. So, as you can see that just about covers all of us except the liberal democommies. Lindsey Graham has already stated that the United States is also a battle field against terrorism so that pretty much covers it all doesn’t it?

          1. a young guy would come home from the battlefield with arms and legs missing or whatever other major injuries;

          2. to show appreciation for his extreme sacrifice, we are expecting HIM to pick up his own bills;

          3. many of these guys are still quite young and need more work experience so they can save hundreds and hundreds of thousands of dollars to pay for things like a year of rehab, brain surgeries, limb reconstruction, etc.

          4. yet OBASTARD proposed, like a good heartless ‘liberal’, that these fine young folks would pull money out of thin air, and have the money/time/project management resources/contacts/fundraising ability/whatever to do this.     The 3rd Amendment and the 7th will easily fall. Under the 3rd, all we need is Marshal law and under the 7th, we have little rights in redress against the tyrannical government. We, the citizens of the United States seem to have less standing than illegal aliens that have invaded our sovereignty and live outside of our Constitution and outside of our rule of law with representation without taxation.

    How is this a good thing while waterboarding is an evil thing? The way I see it, after waterboarding, the perp is alive, and we have gleaned important info; after a drone attack, the perp is dead and our president is judge, jury and executioner–and god. This is not a wise power to give to this president who can change his mind at the drop of a hat and who thinks his own executive orders replaces Congress–and whose DOD is training military men and women that conservatives, Christians, and Catholics are domestic terrorists.

      I agree — the purpose of waterboarding is to cause panic. There is no true danger. It’s a psychological method that’s cruel, sure, but if it saves lives by getting us valuable information, why not use it on a person highly suspected of being involved in terrorist cells? With due process, of course. It’s far better (in my opinion) than beating the information out of somebody, or invoking torture in the physical sense. But hey! Killing people is okay. Lives are meaningless in the face of the decrees of all-knowing secular Jesus: Barack Obama.
      All liberal “logic” is screwy. It makes your head hurt to try to make sense out of it.
