Sheriff Clarke’s Getting Sued By A Millennial Over A Hilarious & ‘Offensive’ Facebook Post – No, This Isn’t Satire
They must not be teaching kids about the First Amendment in School anymore. That’s really too bad.
There was an ‘incident’ at the airport.
In an age where flashing ‘finger guns’ to another Texas Tech student can get you pulled aside by security, security erred on the side of caution with the one passenger. He sued for several reasons, all but one of which have been thrown out of court.
The FB taunt is still being considered by the courts.
In the meme is a photo of the guy who sued.
The judge said there were a couple of ways the image could have been taken:
On one hand, the posts could be seen as ‘intentionally hyperbolic (and juvenile) attempts at mockery and self-promotion’ and not intimidating.
But, he also said ‘the Court cannot say Clarke’s posts were so trivial that no jury could find them to be sufficiently threatening.’
The trial is expected to last all day Monday. While Black is likely to testify, it’s less clear whether Clarke will take the stand.
Black wants a jury to award him a compensation amount that they choose for emotional distress and other damages, as well as attorneys’ fees.
Should this even be going to court?
