Just days after Biden ATF appointee tells us confidently that he will be happy to ban assault weapons, a judge weighs in on the constitutionality of that kind of plan.
Remember the Constitution, Joe? The fancy document that caused all the fuss in the movie National Treasure? Turns out it exists in real life, too. And at least one judge in California has read it.
Ruling on California’s ‘Assault Weapon’ Ban
A California gun law dating back to the final years of the Cold War has been brought before the courts and has been struck down as being unconstitutional.
Gavin Newsom has called the ruling a ‘slap in the face’. If upholding the Constitution is a slap in the face, our politicians could use some more slapping.
U.S. District Judge Roger Benitez of San Diego ruled that the state’s definition of illegal military-style rifles unlawfully deprives law-abiding Californians of weapons commonly allowed in most other states and by the U.S. Supreme Court.
“Under no level of heightened scrutiny can the law survive,” Benitez said. He issued a permanent injunction against enforcement of the law but stayed it for 30 days to give state Attorney General Rob Bonta time to appeal.
…In his 94-page ruling, the judge spoke favorably of modern weapons, said they were overwhelmingly used for legal reasons.
“Like the Swiss Army knife, the popular AR-15 rifle is a perfect combination of home defense weapon and homeland defense equipment. Good for both home and battle,” the judge said in his ruling’s introduction.
That comparison “completely undermines the credibility of this decision and is a slap in the face to the families who’ve lost loved ones to this weapon,” Newsom said in a statement. “We’re not backing down from this fight, and we’ll continue pushing for common sense gun laws that will save lives.” — ABC

That’s the dirty little secret the Left refuses to acknowledge.
Lawful gun owners act lawfully. Because they tend to go quietly about their lives, and aren’t required by their jobs to run headlong into dangerous situations where snap decisions need to be made, legal gun owners have an even better safety record than law enforcement.
Statistics tell us the vast majority of gun crime is not perpetrated by legal gun owners and school shooters. The majority of crimes involving guns aren’t even done by rifles of any kind — ‘scary’ black rifles made by Armalite or otherwise.
A closer look at those major cities with skyrocketing homicide rates might offer some clues about where the problem really lies.
If Democrats really cared about ‘gun violence’ as much as they pretend to, they should turn their attention to that problem.
But their gun policy has never been about the violence and the lives. It’s always been about the narrative — and the control of the many by the few.
