LEGAL RULINGS: Bad News Piles Up In Court For The COVIDictators’ Vax Mandates

It may be just a skirmish in the larger war, but it’s a good sign when the courts’ responses were anything but dismissive of the complaint about the Biden administration’s nasty overreach.

Just last week, (just AFTER the elections!) the mandate we had heard so much speculation about finally came down from on high.

Biden is sidestepping the normal legal processes and using government flunkies to issue binding regulations on citizens that the government most likely lacks the authority to enact. We can’t help but notice the mandate — despite the alleged urgency of the viral pandemic it is being issued in response to — doesn’t actually take effect until AFTER the Christmas season.

Even they understand how bad it would look if the government was forcing the firing of people en masse just before Christmas, not to mention the additional havoc that would wreak on supply lines and travel. So they are waiting until January.

Texas reacted immediately after the mandate was issued, challenging its legality. They said they would, and they did.

But it wasn’t just the Texas AG.

Here’s the reaction in New Orleans

The federal appeals court in New Orleans temporarily blocked the Biden administration’s vaccination mandate for businesses with at least 100 employees.

A three-judge panel with the 5th Circuit Court of Appeals issued the stay Saturday on behalf of the state of Mississippi, the Tupelo-based American Family Association and many other petitioners seeking a delay in the mandate’s enforcement.

The order only cited that “the petitions give cause to believe there are grave statutory and constitutional issues with the mandate.”

The federal government has until 5 p.m. Monday to respond to the request for a permanent injunction, and those wanting the injunction get until 5 p.m. Tuesday to give a response. —WTVA

And in South Carolina…

SC AG Alan Wilson said, “The Court has seen the merit of our filing and others’. The Constitution will prevail. The President is not above the law. The courts may be all that is left between us and abuse of power.” —ABC

Even in Deep-blue Chicago COVIDictators have just lost a judicial ruling

Judge Raymond W. Mitchell of the Cook County Circuit Court said that as unionized employees, police officers had a right to have their objections to the mandate heard by an arbitrator before the requirement takes effect. If an arbitrator were to rule against the city after the vaccine mandate was being enforced, the judge wrote, there would be little recourse for officers who got vaccinated under duress.

“An award of back pay or reinstatement cannot undo a vaccine,” Judge Mitchell wrote. “Nothing can.”

…In Chicago, Judge Mitchell’s ruling left in place a requirement for officers to report their vaccination status to the city, which the police union has opposed, and to undergo regular testing if not vaccinated.

“The reporting obligation itself is a minimal intrusion particularly considering that police officers are already obligated to provide medical information to their employer,” the judge wrote. — NYTimes

It would easier to list the states that support the mandate

In all more than half of the states have indicated opposition to some aspect of the mandates.

At least 27 states filed lawsuits challenging the rule in several circuits, some of which were made more conservative by the judicial appointments of former Republican President Donald Trump.

The Biden administration has been encouraging widespread vaccinations as the quickest way to end the pandemic that has claimed more than 750,000 lives in the United States. — DetroitFreePress
