Abbott Activates National Guard To Bring Illegal Border-Jumpers To Ports Of Entry

Abbott has officially invoked his powers to take the border control action that Joe Biden did not.

While stopping short of actually joining the opinion of the judge who has called the border crisis an ‘invasion’ Abbott is invoking some of the same powers referenced in that disaster declaration in order to mobilize the National Guard to intercept and interdict foreigners flooding over our border.

Governor Greg Abbott today issued an executive order authorizing and empowering the Texas National Guard and the Texas Department of Public Safety to apprehend illegal immigrants who illegally cross the border between ports of entry and return them to the border. The Biden Administration’s decision to end Title 42 expulsions and the Remain-in-Mexico policy has led to historic levels of illegal crossings, with 5,000 migrants being apprehended over the July 4th weekend, creating a border crisis that has overrun communities along the border and across Texas.

“While President Biden refuses to do his job and enforce the immigration laws enacted by Congress, the State of Texas is once again stepping up and taking unprecedented action to protect Americans and secure our southern border,” said Governor Abbott. “The cartels have become emboldened and enriched by President Biden’s open border policies, smuggling in record numbers of people, weapons, and deadly drugs like fentanyl.” — Breaking911

The July 7th Executive Order gave two full pages of ‘whereas’ clauses laying out the rationale for the action being ordered and the authority on which it is based. It describes the failure of Biden to secure the border, the longstanding nature of the crisis, the legal authority on which this order rests before giving the order itself:

NOW, THEREFORE, I, Greg Abbott, Governor of Texas, by virtue of the power and authority vested in me by the Constitution and laws of the State of Texas, do here by authorize and empower the Texas National Guard and the Texas Department of Public Safety to respond to this illegal immigration by apprehending immigrants who cross the border between ports of entry or commit other violations of federal law, and to return those illegal immigrants to the border at a port of entry.

This executive order shall remain in effect and in full force unless it is modified, amended, rescinded, or superseded by the governor. This executive order may also be amended by proclamation of the governor. —Gov Abbott Ex Order, July 7, 2022

Immigration is a Federal responsibility, so it isn’t clear that Texas has any legal authority to throw everyone out of the country. But they can divert them away from the elaborate system that Biden’s administration has set up for those who get picked up crossing the border by bringing them to a legal port of entry.

Different agencies will be making that contact. They will offer different resources and pose different problems.

It might even free up a lot of personnel who have been too busy escorting those floods of people to the next stage of their Get Into America Scott-Free journey to stop the record-setting amounts of fentanyl and Heaven alone knows what other contraband from flowing into the country unhindered.

Is it a perfect solution? No. Not by a long chalk.

But it’s better than what Joe’s been doing. Anything that throws a wrench in Joe’s plans is better than nothing.
