BIDEN’S CLASSIFIED DOCS: Law Prof Raises Stakes — ‘Lawyers Likely Witnesses In Criminal Investigation’
If Democrats were hoping this issue would quietly blow over, then they misjudged how high public expectations have been since the Mar-A-Lago raid.
Every detail of classified document handling has now been elevated to ‘National Emergency’ status, and because of the DOJ’s very public criminalizing of their investigation of Trump, the expectation has been set that any subsequent investigation into the Biden family should be scrutinized every bit as carefully.
To hear Biden’s friends in the press tell the story, everything on the Biden side of this ledger has been on the up-and-up. Nothing to see here. We found some things, and handled it by the book.
But Johnathan Turley, a Law Professor from George Washington U — who was one of the few impeachment witnesses Schiff actually permitted to stand in Trump’s defense — doesn’t see it that way. If anything, their handling of the Biden classified documents issue from the time the error (?) was first discovered has likely taken the problem from bad to worse.
Here’s how he explains the problem (emphasis added):
Turley told Fox News Digital that we “do not know what the evidence will show” and that the “most serious discovery would be evidence that Biden worked off their documents or removed them from their classification folders.”
“That would not only destroy the ‘inadvertence’ defense but make his public comments potentially deceitful of both the public and investigators,” Turley said. “While gross mishandling does not require evil intent, unintentional violations are often addressed outside of the criminal justice system. The most serious violations have been prosecuted where material was intentionally removed.”
“Intent can be established not only at the time of the removal but during the storage of the documents.” he continued. “If these documents were used or knowingly possessed over the six years, it would qualify as an intentional act to unlawfully possess the material.”
Turley added that the “use of private counsel without clearances following the first discovery on Nov. 2 could itself be viewed as reckless and gross mishandling.”
“Moreover, those lawyers are now likely witnesses in a criminal investigation,” Turley said.
Biden and Garland were so busy digging a hole to catch Trump, they didn’t ask themselves what happens if one of their friends fell into it.
And now… it’s too late to fill it in again.
What happens from here is entirely uncharted territory.
