COLLISION COURSE: Immigration Stakes Ratchet Even Higher As SCOTUS Remains AWOL

Hey Roberts... how long are you going to let this spiral out of control?

A straightforward division of powers question that SCOTUS could have resolved early on is metastasizing into a full-blown constitutional crisis, with each side determined the other is dead wrong.

Depending on your role in the government, you will have a very different ‘take’ on what’s gone wrong in a series of disputes that argue over points of law that are already governed by deeply-established precedent.

We’re talking, of course, about the border crisis, especially in the context of individual cases Dems pick as their political champions, including the ‘Maryland Man’ MS-13 case.

Historically, immigration and border issues fall squarely within the established responsiblities of the Executive branch, in the same way that adjudicating guilt or innocence is judicial, and budgets are Congressional responsiblities.

The Alien Enemies Act was tested in court and it has been ruled that courts, because of the division of powers, have no authority to review how the Executive branch applies it. Similarly, judges have no authority to insist (contrary to law) that federals get a warrant before arresting someone for which they already have just cause to detain them… as Senator Lee has mentioned in his response to something dumb a judge did.

For good or for ill, the political left has identified this as their nail-their-colors-to-the-mast issue. They think this is the one that will rally the public to their cause, and energize their base for their next ‘threat to democracy’ screechfest as we move toward the midterms.

Predictably, House Democrats are already tripping over themselves to push for — what else? — impeachment.

Some have even booked trips to El Salvadore in signs of solidarity with the ‘Maryland Man’ who just happens to be sporting some sketchy knuckle tats. Nothing to see here.

In the lawfare front, we’ve got more and more judges lining up every day to exercise powers they’ve never actually possessed just to throw a wrench in the process and slow down the deportations of their precious illegal aliens.

As an example, the tweet Senator Lee was reacting to:

Yes she WAS a Biden appointee. How’d you guess?

Every day we see new examples of Democrat activism doubling down on their defense of illegals… from Sanctuary Cities, to marches and sit-ins, to outrageous laws being proposed as ‘Resistance’ in Blue States.

Of course, that kind of enemy-of-my-enemy-is-my-friend has a way of backfiring. Not only have they made to look stupid for supporting actual terrorist sympathizers (Hamas, of course), but that whole ‘Maryland Man’ narrative is quickly coming unspooled, too.

Trump, for his part, is directing the Executive Branch to treat the law as binding, and apply real consequences to anyone who thinks themselves above the law. Full details here:
