America First Legal is taking dead aim at a Biden policy that made race-based considerations a MANDATORY step in adding racial considerations to life-and-death decisions on who’s next in line for an organ transplant.
When Biden was busted right out of the gate for deliberately excluding white farmers from subsidies that went to other farmers — we called it out for the illegal and unconstitutional obscenity that it so obviously was.
But Team Biden was hard at work, embedding that philosophy into every corner of American life and governance they could possibly slip their tentacles into. And that includes life-saving health care.
Under Biden’s administration, the priorities of closest match and highest need are no longer the only considerations that hospital staff are obligated — OBLIGATED — to take into consideration when matching organs to recipients.
Under Biden’s new rules, failing to check the right identity boxes could be a literal death sentence. It’s all of the bass-ackward politicized thinking that drove refusal of lifesaving treatment to the unvaxxed… ramped up 10,000 percent.
America First Legal (AFL) launched a new investigation into the Biden Administration’s effort to embed diversity, equity, and inclusion (DEI) into the nation’s organ transplant system.
AFL filed three Freedom of Information Act (FOIA) requests with the U.S. Department of Health and Human Services (HHS), the Health Resources and Services Administration (HRSA), and the Centers for Medicare & Medicaid Services (CMS) to expose how the Biden Administration injected racial preferences into life-and-death organ transplant decisions through the Increasing Organ Transplant Access (IOTA) Model.
The IOTA Model is a mandatory, six-year federal program that took effect on July 1, 2025. It fundamentally changes how transplant hospitals decide who receives a kidney in the transplant process. Instead of relying solely on medical urgency, the Biden Administration directed hospitals to factor in race, ethnicity, and “equity” when making allocation decisions.
Under this program, select hospitals must operate within an equity-driven framework that pressures them to adopt race-conscious organ allocation policies. As part of the Model, hospitals are encouraged to submit “Health Equity Plans” to CMS, (Read the full press release here)
They are looking to unmask everyone behind these policies. They want names, studies, legal opinions the whole schlemiel. From that same release:
“The Biden Administration deliberately wove race and equity mandates into the organ transplant system, risking the lives of patients who may be denied a kidney because of their skin color rather than their medical need,” said Megan Redshaw, counsel for America First Legal. “The public has a right to see exactly how these discriminatory policies were conceived, justified, and encouraged inside the federal government.”
Not only does the public have such a right, but those responsible for violating the Constitutional Rights of citizens ought to be permanently barred from any employment paid with taxpayer dollars… including ‘consulting’ work.
