Pro Gun Group Sues Liberal City For ‘Assault Weapon’ Gun Grab – Here’s What’s Going Down

Written by K. Walker on April 6, 2018

Moral of the story: Before cramming your agenda down our throats, know the limits of your own authority.

Deerfield Illinois made the news earlier this week when they issued an honest-to-goodness gun-grabber law. It included a thousand-dollar-a-day fine for non-compliance.

(If you ever needed a reason to distrust gun registries, here is your case-in-point argument against their existence delivered with a big red bow.)

Now they’re making the news again. Because — predictably — they’re facing a great big lawsuit.

First, let’s recap what the offending legislation looks like:

Rulemakers in the village of Deerfield, Illinois, have voted unanimously to ban semi-automatic rifles, along with pistols and shotguns “with certain features.” Deerfield also voted to ban magazines that hold more than 10 rounds of ammunition.

The ban passed Monday night outlaws any weapon the village leaders deem “assault weapons,” including AR-15s. But the ban also includes “semi-automatic rifles, pistols and shotguns with certain features.”

Say it with me boys and girls… ‘shall not be infringed’.

So what was the basis of the lawsuit? Not quite what you might expect. It wasn’t a 2nd Amendment fight at all. It took a very different approach.

Here’s Second Amendment Foundation’s Press Release:

The Second Amendment Foundation today filed a lawsuit against the Chicago suburb of Deerfield, Illinois seeking an injunction against enforcement of the ban on so-called “assault weapons” and “large capacity magazines” adopted by the Village Board of Trustees earlier this week.

Joining SAF in the legal challenge is the Illinois State Rifle Association and a private citizen, Daniel Easterday, who resides in the village and is a gun owner. The lawsuit was filed in the 19th Judicial Circuit Court in Lake County. Plaintiffs are represented by Glen Ellyn attorney David Sigale.

The lawsuit challenges the village ban under a 2013 amended state statute that declared “the regulation of the possession or ownership of assault weapons are exclusive powers and functions of this State. Any ordinance or regulation, or portion of that ordinance or regulation, that purports to regulate the possession or ownership of assault weapons in a manner that is inconsistent with this Act, shall be invalid…”

“We moved swiftly to challenge this gun ban because it flies in the face of state law,” said SAF founder and Executive Vice President Alan M. Gottlieb. “While the village is trying to disguise this as an amendment to an existing ordinance, it is, in fact, a new law that entirely bans possession of legally-owned semi-auto firearms, with no exception for guns previously owned, or any provision for self-defense.

“The new ordinance also provides for confiscation and destruction of such firearms and their original capacity magazines,” he added. “What is particularly outrageous about this new law is that it levies fines of up to $1,000 a day against anyone who refuses to turn in their gun and magazines or move them out of the village by the time the ordinance takes effect in June. This certainly puts the lie to claims by anti-gunners that ‘nobody is coming to take your guns.’”

Clever. They don’t even have to make the case about ownership of this or that kind of gun. They’re going right to the source: they are exerting power they have no right to wield.

What a beautifully American response to such pig-headed tyranny.

What makes America so different from other nations? Other nations are built around regimes or systems. But America was built from on ideas. From a blank slate.

Built on ideas that are DANGEROUS to tyrants.

That we have God-Given Rights, like Life, Liberty and the pursuit of happiness.

Dangerous ideas. Like this one: the people, when threatened, have a God-Given right to stand up in defiance of any government that dares threaten any of those rights.

There’s a men’s version

And a women’s version, too

Because in America, the bros AND the ladies BOTH have a rich history of badass rowdiness.
