Two Takes On Where Trump’s Court Challenges Could Be Headed

There’s a lot of speculation about what Trump will be bringing before the courts, and whether they will make a big enough splash to reverse election results that so many already consider finalized.

Even here at Clash, we’ve seen a variety of theories, cross our desk.

Some of them come from anonymous sources claiming insider information we have no way to either confirm or disprove, and others take their cue from a reasoned examination of the Constitution.

We’re going to pull back the curtain and show you both.

First, here is the claim purportedly coming from a Trump team insider, as originally written:

Ok in a nutshell. This is going to the Supreme Court. Where They will rule that the election is invalid due to fraud or mistakes on a countrywide scale. It will go one of two ways, either they will rule that all the unconstitutional mail-in ballots will be removed and the states ordered to recount without them or they will simply rule the election is invalid due the mass voter fraud and at that point it will be sent to the congress and senate for a vote.

This is where it gets good. The house/congress votes on who the President will be. It has nothing to do with what party has that power. Every State gets one vote and 30 States are held by Republicans and 19 by Democrats. They have to vote down party lines, they have no choice due to the 12th Amendment of the Constitution and the Senate votes for the Vice President where a similar event will take place. This is the law.

This is why the Democrats are so mad at Nancy Pelosi. This will all happen in January. The only way President Trump won’t be President is if he concedes the election and that will never happen.

So, stop watching the fake news and don’t let your heart be troubled and live your life knowing this will all work out. President Trump will remain President.

I have researched all of this and it is Fact! Another fun fact, they called Gore the President Elect for 30 days in 2000 until the courts ruled against him and declared Bush the willer. And two people that were part of Bush’s legal team were none other than new Supreme Court Justices Brett Kavanaugh and Amy Coney Barrett. Why do you think the Democrats tried so hard to keep them from being confirmed?

Are those mechanisms within the Constitution? Sure.

Is that Team Trump’s plan? We don’t know. For one thing, even just declaring an entire election ‘invalid’ seems something of a longshot.

Let’s look at a theory this writer considers a more likely course of action. Mark Levin and Kenneth Starr are discussing what’s likely to happen next:

Since September, Levin has been explaining to his audience that Biden’s lawyers have been systematically hitting courts in different states with hundreds of court cases to have court-mandated changes to the electoral law.

As explained in the ‘How Democrats Are Attempting To Sow Uncertainty, Inaccuracy, And Delay In The 2020 Election’ document produced by the Senate Judiciary committee (which we covered here) these court challenges had as their objective to move the goalposts in the Democrats’ favor, AND to reduce the effectiveness of the security protocols that protect the vote from illicit tampering.

Levin’s argument has been that a clause of the Constitution stands alone as the only time that State legislatures are set apart as having exclusive authority over something, namely setting the rules of an election.

The courts do not have power overrule that authority, nor do any election officials.

Levin’s argument is that some of the changes that team Biden has pushed for unconstitutionally bypassed legislatures explicit lawmaking, and are therefore explicitly unlawful.

This means that the rule of law as given, not as modified on the fly, in courts, or at that last minute, is the rule by which these counts must be interpreted.

If confirmed and enforced by SCOTUS, depending on the wording, this could have a significant impact on State elections across the country. If you follow the link to that Senate Judiciary story, you will find that the States they’ve red-flagged have a striking resemblance to the ones we’ve been seeing in the news.
