Texas Judge Gives Planned Parenthood Some Bad News

It’s nice to have some good news to report in the midst of an administration whose 100-day goal, judging by their results so far might be the total collapse of a wide array of political and societal norms.

In the midst of this battle, at least one of the Democrats’ corrupt institutions and principal financial contributors can be said to be losing territory.

A state judge ruled on Wednesday that Texas can remove Planned Parenthood from its Medicaid program, preventing those enrolled from using the program to get nonabortion services from the organization.

Judge Lora Livingston decided that Texas officials had given appropriate notice to Planned Parenthood of the upcoming removal that is required under state law, after the advocacy organization contested in an emergency lawsuit that the state had not.

Texas has aimed to remove Planned Parenthood from Medicaid for several years, including by providing a notice of termination in 2016. In response at the time, the group took the state to court resulting in the 5th U.S. Circuit Court of Appeals decision last year in favor of Texas.

The state’s legal team argued that Planned Parenthood could have appealed the termination back then but chose not to, an argument that Livingston ultimately agreed with. –Hill

They could have sought administrative appeals, but they opted to go through the courts. Now that the court has ruled against them, any administrative option to appeal the original 2016 notice has long since lapsed.

Because they chose the federal courts to contest their case, the judge said, the federal courts will be the setting of any resolution.

It is not yet stated whether Planned Parenthood will appeal this ruling, although with their history of litigation, it seems unlikely they would accept this loss lightly if they have even the slightest hope of challenging it.
